1. Who your contractual partner is

These terms govern the sale of goods, the hire of equipment and the brokering of mountain guide tours through this online shop. The provider and seller is:

Please read these terms carefully before you place an order. A consumer is a person who concludes the contract for purposes which are outside their trade, business or profession. Consumers additionally enjoy the mandatory provisions of the Italian consumer code (D.lgs. 206/2005, Codice del consumo). Nothing in these terms restricts those rights.

2. How the contract comes about

The presentation of items in the shop is not yet a binding offer, it is an invitation to you to make one. The path to a contract looks like this:

  1. You put items into the basket.
  2. At checkout you give your contact details and choose delivery or collection, the delivery address and the payment method.
  3. You see a summary with all items, the total price including VAT, and the shipping costs.
  4. By clicking the button that completes the checkout and expressly states the obligation to pay, you make a binding offer.

Once your order reaches us we send you an order confirmation by email without delay. That confirmation only acknowledges receipt (Art. 13 D.lgs. 70/2003) and is not yet an acceptance. A contract of sale comes about when we dispatch the goods you ordered and confirm this with a dispatch confirmation. If your order is sent in several parcels, you receive a separate dispatch confirmation for each parcel; in that case each dispatch confirmation creates its own contract of sale. If you chose collection in store, the contract comes about as soon as we write to you that the order is ready for collection.

Until the dispatch confirmation you can cancel your order free of charge. This does not apply to mounted ski sets and personalised goods. You receive your invoices electronically. We sell in normal household quantities only.

3. Spotting and correcting input errors

Before you send the order off bindingly, you see all your details once more in a summary. As long as you have not clicked the button that states the obligation to pay, you can change every detail. You can adjust quantities in the basket or remove items, go back through the checkout steps to the address, the shipping method and the payment method and correct them, or break off the process by closing the window. If you notice a mistake after sending the order, write to us straight away at info@mountainspirit.it or ring us. As long as the goods have not been dispatched, we will correct or cancel the order.

4. Language of the contract

The contract can be concluded in German or in Italian. These terms are available in both languages. If you order through another language version of the shop, the contract comes about in German. Where the language versions differ, the version in the language in which you ordered applies to you.

5. Storage of the contract text

We store the data of your order. You receive it by email with the order confirmation and with the dispatch confirmation, so please keep those emails. If you have set up a customer account, you will also find your orders there. You can call up these terms on this page at any time, print them and save them as a file.

6. Right of withdrawal and returns

As a consumer you have a right of withdrawal of 14 days without having to give any reason. You will find all the details, the time limits, the exceptions and the effects of withdrawal on the page Returns and right of withdrawal. Those statements form part of these terms.

7. Prices

The prices that apply are those in force at the time of the order. All prices are final prices in euros and include VAT at the statutory rate. Shipping costs are not included. They are shown separately in the basket and at checkout, before you send the order off bindingly, and they are set out under Delivery and shipping costs. If a product has been priced incorrectly by mistake, we contact you before dispatch. If the correct price is lower than the one shown, we charge you the lower amount.

8. Payment and retention of title

You will find the available payment methods under Payment methods and prices, and they are shown to you conclusively at checkout. We reserve the right to exclude individual payment methods. Every product we deliver remains the property of Mountain Spirit until it has been paid for in full (retention of title under Art. 1523 et seq. of the Italian Codice civile).

9. Delivery, delivery periods and passing of risk

We deliver to the delivery address you give us, or we hold the order ready for collection at our shop in Bolzano. The countries we deliver to, the shipping costs and the usual transit times are set out under Delivery and shipping costs. The transit times given there are based on experience and start when the goods are dispatched.

Independently of that we deliver at the latest within 30 days of the conclusion of the contract, as Art. 61 Codice del consumo requires. If we cannot meet that period we let you know, and you can set us a reasonable additional period. If we still do not deliver, you can withdraw from the contract and get everything you have paid back without delay. If products you have ordered are not available, we tell you by email. Your statutory rights are not affected.

Until the goods physically reach you, or a person named by you who is not the carrier, we bear the risk of loss and damage (Art. 63 Codice del consumo). If a parcel is lost in transit or arrives damaged, that is our risk and not yours. Please get in touch with us in that case.

10. Customs

For deliveries outside the European Union, import duties, import VAT and customs agent fees may apply. The recipient bears these costs, they are not included in our prices. Customs rules differ from country to country, so please check with your local customs authority.

11. Legal guarantee of conformity

As a consumer you have the legal guarantee of conformity under Art. 128 et seq. Codice del consumo. We are liable for any lack of conformity which becomes apparent within two years of delivery (Art. 133 comma 1). If a defect becomes apparent within the first year after delivery, it is presumed to have existed already at delivery, so you do not have to prove it (Art. 135). There is no period for giving notice, you do not have to report the defect within any set time. Your claims become time barred in any event 26 months after delivery (Art. 133 comma 3).

You can first request repair or replacement, at your choice and free of charge for you. If both are impossible or disproportionate, or cannot be achieved within a reasonable time and without significant inconvenience for you, you can reduce the price or terminate the contract (Art. 135-bis).

For second-hand goods we can agree a shorter period with you, of at least one year from delivery (Art. 133 comma 4). Where that applies, it is expressly stated with the item before you order. Further details are set out under Returns and right of withdrawal. The simplest way to report a defect is to write to info@mountainspirit.it with the order number and, if possible, a photograph.

12. Liability

Mountain Spirit is liable without limitation for intent and gross negligence and for injury to life, body and health. Where a material contractual obligation is breached through slight negligence, Mountain Spirit is liable for the foreseeable damage typical of this kind of contract. Liability is otherwise excluded. Where liability is excluded or limited, this also applies to the personal liability of employees, representatives and vicarious agents. Liability under the rules on product liability and the mandatory rights you have as a consumer are not affected.

Part of our range is personal protective equipment. The manufacturer's instructions supplied with each item govern its use, inspection, retirement criteria and service life. Our product texts do not replace them.

13. Hire

A reservation order becomes valid with the written or telephone order confirmation. We hold the reservation until closing time on the day of the reservation, after which it lapses.

A security deposit must be lodged in order to hire sports equipment. Every hirer is liable for returning the equipment in proper condition, up to the retail value of the items hired. Lodging a security deposit does not count as a possible purchase price for the equipment. In the event of loss, breakage and theft the hirer pays the full current value.

The minimum hire period is half a day. If the hired equipment is returned only after 13:00 on the following day, an additional day has to be paid for.

Our staff will brief you on how to use the equipment. We recommend that all hire customers go with a mountain guide. By signing the hire form you declare that you agree to these terms. The equipment is handed over and taken back at the shop in Bolzano.

14. Brokering of mountain guide tours

Through this shop you can send enquiries to self-employed mountain guides. Mountain Spirit puts you in touch, no more than that. The contract for the tour or the course is concluded exclusively between you and the mountain guide, on that guide's terms and at that guide's prices. Mountain Spirit is neither a tour organiser nor a travel agent within the meaning of the Codice del Turismo, owes no mountain guiding service and is not liable for the way it is carried out. The mountain guide alone is responsible for professional qualification, insurance and the conduct of the tour.

15. Dispute resolution

If something is not right, come to us first at info@mountainspirit.it or +39 0471 05 34 34. Most things can be sorted out that way.

If we cannot reach agreement, as a consumer you can start an out of court conciliation procedure. For consumer disputes arising from online sales we take part in the procedure of the ADR body “Onlineschlichter.it”: Zwölfmalgreinerstraße 2, 39100 Bolzano (BZ), tel. +39 0471 975597, info@onlineschlichter.it, www.onlineschlichter.it. The body itself will tell you the conditions of the procedure and any costs.

The European Commission's online dispute resolution platform (ODR platform) no longer exists. It was shut down by Regulation (EU) 2024/3228 with effect from 20 July 2025, so a link to it would lead nowhere. For cross border purchases the European Consumer Centre advises you free of charge, in Italy at www.ecc-netitalia.it.

The way to the ordinary courts is always open to you, a conciliation procedure is not a precondition for it.

16. Applicable law and place of jurisdiction

Italian law applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). If you are habitually resident in another state, the mandatory consumer protection provisions of that state are not affected (Art. 6 of Regulation (EC) No 593/2008, Rome I).

If you live in Italy as a consumer, only the court of your place of residence or domicile has jurisdiction. That jurisdiction is mandatory and cannot be contracted out of (Art. 66-bis Codice del consumo). If you live in another Member State of the European Union as a consumer, you can sue us at your choice either at your domicile or in Bolzano, and we can sue you only at your domicile (Art. 17 to 19 of Regulation (EU) No 1215/2012). If you are not a consumer, the place of jurisdiction is Bolzano.

17. Code of conduct

Mountain Spirit has not subscribed to any code of conduct within the meaning of Art. 12 comma 1 lettera d of D.lgs. 70/2003.

18. Changes to these terms

We reserve the right to change these terms at any time. The terms that apply to your order are the ones in force at the time of the order. If any provision is invalid, the validity of the remaining provisions is not affected.

19. Minors

We do not offer products for purchase by minors. If you are under 18, use is permitted only with the involvement of a parent or guardian.

20. Copyright and trade marks

All content in this shop, in particular text, graphics, logos and images, belongs to Mountain Spirit or to its suppliers and is protected by copyright. Systematic extraction or re-use, in particular by data mining or automated means, is not permitted without our express written consent.
